Litigation Support
Managed nearly 20 litigation cases through discovery and deposition, and in mediation, achieving settlement, for example:• Litigation Support through Deposition and Settlement - As project manager for a a confidential petroleum client, Ms. Quinn reviewed more than 15 years of historical data related to a former oil production well field to prepare two testifying experts. This fast-track project involved review and evaluation of data collected at over 500 areas of concern (more than 150 former oil production wells, and sumps, methane gas compressor stations, and other oil production support facilities), including over 75 monitoring wells, 2,600 borings, and 700 trenches. Ms. Quinn directly supported attorneys and the testifying experts through both plaintiff and defendant depositions until settlement was achieved. • Litigation Support through Deposition - For a former gun range in San Diego, Ms. Quinn reviewed a potential purchaser’s assessment of the extent of lead impacted soil and lead shot remaining on the property, and the cost to remediate impacted materials. The assessment included review of past land use records, including gun range periods of operation by various parties, and lead shot reclamation activities, to derive an estimate of the potential volume of lead shot remaining on the property and extent of associated lead impacted soil. Ms. Quinn reviewed several years of investigation data throughout the 5-acre site and considered regulatory agency thresholds and site specific risk levels for lead in soil to critique the cost analyses. Ms. Quinn prepared an expert report and supported an expert witness testimony in deposition.• Litigation Support and Settlement - In order to successfully negotiate reduced environmental damages and minimize property devaluation related to an active horse racing track facility, Ms. Quinn evaluated available site investigation data, including a methane gas assessment related to former oil production well field, and petroleum and solvent impacted soil and ground water data, to identify areas potentially requiring additional investigation and/or remedial action in order to achieve site closure under the RWQCB-LA Region. Ms. Quinn critiqued alternative potential investigation and remedial action approach and associated costs proposed by the buyer, and developed an impendent opinion. Based on third party review, the transaction was settled favorably for the client.• Litigation Support, Agency Negotiation - As Project Manager for a litigation case involving a former agricultural property to be redeveloped for residential use, Ms. Quinn supported legal counsel in negotiations with the County District Attorney to resolve a dispute about the representative average concentrations of organochlorine pesticides in stockpiled soil and its proper disposition. Ms. Quinn characterized the stockpiled soil in accordance with the EPA SW-846 guidance. The case was settled favorably for the client and the soil was buried at a municipal landfill. • Mediation - For a former waste oil recycling facility, Ms. Quinn provided oversight of data collection by a “neutral tester” to develop discovery evidence in a dispute involving two properties and multiple parties and their legal counsel, technical consultants, and insurance carriers. Ms. Quinn represented claim defendant on a Technical Committee of the joint parties’ consultants to implement site characterization. Ms. Quinn presented the case to the Mediating Judge, and has represented the defendant in joint party negotiations and discussions with the Special Master overseeing the data collection effort to support the litigation. Deposed as percipient witness on this case. • Mediation - For an industrial client ending a 50-year lease, Ms. Quinn reviewed property development and land use history to identify and characterize chemical impacts to soil at the property that likely occurred during the lease period, and those that likely occurred prior to the lease. Much of the case relied upon forensic analysis of historical aerial photographs, with limited investigation data available. Remediation costs for impacts resulting during the lease period were assessed and considered in settlement negotiations. Ms. Quinn presented the technical argument and cost basis before the mediating judge, and the case was settled favorably for the client.• Oversight - Ms. Quinn provided technical oversight and guidance to a team of attorneys, client executives in environmental and public/government affairs, and consultants for a Potentially Responsible Party (PRP) in a Superfund operable Unit involving volatile organic compounds (VOCs) as well as emergent contaminants (hexavalent chromium, 1,2,3 trichloropropane [1,2,3 TCP], perchlorate, 1,4,-dioxane, and n-nitrosodimethylamine [NDMA]). Project involved multiple stake holders, including other PRPs, local, state and federal environmental agencies, and municipal ground water purveyors. • Eminent Domain - For the Port of Los Angeles where eminent domain was exercised to acquire a property occupied by a truck loading facility as part of the Alameda corridor widening, Ms. Quinn managed litigation support, liability control, and site investigation and remediation at a multiple source site including a 25,000-gallon underground storage tank. As part of this comprehensive project, litigation support was provided to the City Attorney for purchase of a former truck loading facility. Environmental liabilities and costs were successfully negotiated into the property acquisition price and Pollution Legal Liability Insurance was secured for the client prior to the purchase of limited liability insurance.

Due Diligence
Pre-divestiture, lease, and acquisition due diligence environmental support to attorneys, land developers, investors, and realtors, including:• ASTM-compliant Phase I Environmental Site Assessments (ESA); • Regulatory compliance assessments;• Potential environmental risk screening and valuations; and,• Strategies to ultimately negotiate site regulatory closure. Representative projects include:• Phase I ESAs - For a variety of manufacturing facilities in Northern and Southern California, Ms. Quinn has completed ASTM-compliant Phase I ESAs, including for specialty metal parts manufacturing, photographic film developing, and commercial warehouse facilities. In some instances, rough order of magnitude costs have been estimated for a range of potential outcomes leading to site closure.• Acquisition of a machining and tool manufacturing facility - on behalf of counsel representing investors, Ms. Quinn provided due diligence review of historical environmental documents to assess potential environmental risks associated with purchase of the property, and associates reviewed available environmental regulatory and safety compliance data to assess potential risk associated with the business operations. A compliance check-list was developed for the regulatory compliance issues and for safety program development, which the business operators used to guide enhancement of the overall environmental and employee safety program at the facility upon purchase.• Industrial client ending a 50-year lease, Ms. Quinn reviewed property development and land use history to identify and characterize chemical impacts to soil at the property that likely occurred during the lease period, and those that likely occurred prior to the lease. Remedial Investigation
Ms. Quinn has guided projects through technical design, implementation, and analysis of all phases of remedial investigations, feasibility studies, and remedial alternative evaluation and design, including at numerous industrial and petroleum facilities, landfills, municipalities and Ports (including the Ports of Stockton, Los Angeles, and Long Beach), and government bases throughout California, Arizona, and Nevada.Project experience includes:Ms. Quinn has extensive direct field experience in design, drilling, and construction of monitoring and production wells using a variety of drilling techniques including direct mud rotary, hollow-stem auger, air percussion, and reverse circulation air rotary dual-tube methods. She has also managed and performed groundwater and soil sample collection and characterization, and aquifer testing and analysis programs.Ms. Quinn served as oversight supervisor for USEPA, Region IX and the RWQCB Los Angeles Region, observing subcontractor field activities at several Operable Unit areas within the San Gabriel Valley Superfund site. Activities observed include drilling, construction, development, and sampling of deep (up to 900 feet below ground surface) monitoring wells and Westbay multiport monitoring systems.As Project Manager for a former Home Depot property in Thousand Oaks, Ms. Quinn characterized subsurface conditions at a site where ground water is impacted by chlorinated VOCs and petroleum hydrocarbons. Through upgradient off-site ground water monitoring, Ms. Quinn was able to show that chlorinated VOCs were likely the result of an upgradient off-site source, and thereby focus the remaining investigation on a hydrocarbon plume related to a former gasoline station on the property. A geophysical survey identified a potential on-site source. Ms. Quinn continues to provide oversight of ongoing characterization and remediation efforts, including an ozone sparging system.As Lead Hydrogeologist for the final phase of the OII Landfill Remedial Investigation, Ms. Quinn reviewed hydrostratigraphic and water quality data collected from over 100 wells and borings to refine the conceptual model of the complex hydrologic system that includes structurally deformed and faulted water bearing units. The interpretation included assessment of groundwater and soil vapor migration pathways and evidence of potential impact to offsite receptors. This information supported the risk assessment and feasibility study phases of the project.As Lead Hydrogeologist for the OII Landfill Feasibility Study, Ms. Quinn developed design alternatives to address leachate collection within the landfill, containment of leachate migrating outward from the perimeter of the landfill, and remediation of contaminated groundwater offsite. Design of alternatives was complicated by the complex hydrogeologic conditions existing in the vicinity, the range in types and characteristics of wastes, and geotechnical and hydrogeologic design constraints. The final remedial design alternatives included installation of barrier walls and collection wells at the perimeter of the landfill, and MNA or groundwater extraction in offsite regions.Ms. Quinn compared each alternative on the basis of technical efficiency, protection of human health and the environment, cost and other factors in accordance with the nine National Contingency Plan criteria. Ms. Quinn presented results of her detailed analyses, conceptual alternative design plans, and results of comparative analyses to the USEPA and major Potentially Responsible Parties.Ms. Quinn performed interim corrective action screening at a former perchloroethylene (PCE) recycling facility located within the Port of Los Angeles. The RCRA Facility Assessment (RFA) received commendation from the DTSC. The project scope included decision analysis of interim and long-term remediation strategies. An Interim Corrective Action Technical Memorandum was issued. Corrective Action technologies for dense nonaqueous phase liquid (DNAPL) and dissolved phase contaminants were evaluated and included six-phase soil heating, barrier wall containment, funnel and gate technology, soil vapor extraction, multi-phase extraction, and MNA.
Remediation Oversight
Kinder Morgan Energy Partners (KMEP), Ms. Quinn managed up to 15 petroleum release remediation projects simultaneously that were impacted by gasoline, diesel, jet fuel, and fuel oxygenates (primarily MTBE and TBA) in soil and groundwater, including:• remote pipeline release sites (many in the Central Valley), • booster stations, • terminals• Port facilities (Carson Terminal, LA Harbor Terminal near the Port of Los Angeles and Stockton Terminal in the Port of Stockton) Ms. Quinn managed operation and maintenance of KMEP vapor treatment and liquids/groundwater treatment systems. Remediation technologies applied at the KMEP sites included:• for mass removal from the vadose zone and “smear zone” soil near the water table: o excavation o soil vapor extraction o chemical oxidant (peroxide) injection (COI) • for chemical containment and reduction in groundwater: o multi-phase extraction wells and trenches o total fluids extraction o air sparging o COI o Monitored Natural Attenuation (MNA) Former Home Depot property in Thousand Oaks, Ms. Quinn provided oversight of ongoing characterization and remediation efforts, including an ozone sparging system for reduction of petroleum-related compounds in groundwater.South El Monte and Whittier Narrows Operable Units - Ms. Quinn refined the basin-wide San Gabriel numerical CFEST model to design an extraction well network for the Whittier Narrows area to intercept groundwater contamination migrating toward the Central Basin. Extraction wells have been installed that meet the location, production capacity, and construction specifications developed based on the modeling effort.National Priorities List (NPL) site in the San Fernando Valley, Ms. Quinn critiqued the production performance of a 2,000-gpm extraction well remediation system, the North Hollywood Operable Unit (NHOU) extraction wellfield, and evaluated the effectiveness of the system in arresting local trichloroethylene (TCE) and tetrachloroethylene (PCE) groundwater contamination.El Toro Marine Corps Air Station, Ms. Quinn used MODFLOW to evaluate remedial alternatives for groundwater contamination in the Irvine Sub-basin. The task involved interpretation of lithologic, geophysical, piezometric pressure, and groundwater chemistry data from hundreds of production and single point and multiport monitoring wells throughout the Irvine Sub-basin, and development of a regional conceptual model for the Sub-basin that was used as the basis for a calibrated numerical model. Particle tracking was performed to evaluate vertical flow rates simulated by the model. The calibrated model was used to develop alternative shallow extraction scenarios effectively balanced with deep groundwater production from the Sub-basin to contain regional TCE groundwater contamination in the area.
Agency Negotiations
Ms. Quinn has negotiated successfully with regulatory agencies including: • United States Environmental Protection Agency (USEPA), Region IX, • Department of Toxic Substances Control (California Department of Public Health), • California Regional Water Quality Control Board (RWQCB) Central Valley, Los Angeles, and Santa Ana Regions, • County agencies, including water districts. Ms. Quinn has negotiated agency-accepted site-specific cleanup criteria for soils and groundwater, including by:• vadose zone fate and transport models (VLEACH, BIOSCREEN); • risk-based soil gas values protective of indoor air quality (Johnson-Ettinger model);• statistical characterization methods (e.g., stockpile characterization by EPA SW-846 Guidance); and,• relying upon conclusions of site specific risk assessments.USEPA, Region IX and the RWQCB LA for San Gabriel Valley Superfund site: Ms. Quinn served as oversight supervisor for USEPA, Region IX and the RWQCB Los Angeles Region, observing subcontractor field activities at several Operable Unit areas within the San Gabriel Valley Superfund site. Activities observed include drilling, construction, development, and sampling of deep (up to 900 feet below ground surface) monitoring wells and Westbay multiport monitoring systems. Ms. Quinn also participated in cost allocations and negotiations between PRP Steering Committees and USEPA.RWQCB LA: For several sites, including a former Unocal chemical storage terminal and the Air Force Plant 42, Ms. Quinn used fate and transport modeling to develop soil screening and clean-up values exceeding levels provided in RWQCB-LA Region guidance. The values represent contaminant concentrations that can be left in place in soil without posing a risk to groundwater. The regulatory agencies agreed to the approach, which involved analysis using the VLEACH analytical model and a groundwater mixing cell model. The use of the screening values at the former Unocal site helped to minimize the volume of soil requiring excavation and off-site disposal (at tremendous cost savings for the client), and at Plant 42 helped to minimize vadose zone remediation efforts, and limited the soil boring investigation through the risk-based, fate and transport approach. RWQCB - LA at Port of Los Angeles: Negotiated closure of a 25,000-gallon petroleum UST on a property in the Port of Los Angeles where eminent domain was exercised to acquire a truck loading facility as part of the Alameda corridor widening, Ms. Quinn managed litigation support, liability control, and site investigation and remediation at a multiple source site including a 25,000-gallon underground storage tank. As part of this comprehensive project, litigation support was provided to the City Attorney for purchase of a former truck loading facility. Environmental liabilities and costs were successfully negotiated into the property acquisition price and Pollution Legal Liability Insurance was secured for the client prior to the purchase of limited liability insurance. Monitored Natural Attenuation (MNA) was also successfully negotiated, screened with the BIOSCREEN model. The RWQCB approved the site characterization, which included geophysical and soil gas surveying (source identification) and HydroPunch and quarterly groundwater monitoring to support the MNA assessment. DTSC: Achieved regulatory closure with unrestricted land use for an active chemical production facility where organic compounds were formerly used. Negotiation of closure with the RWQCB LA was achieved following 20 years of investigation of soil gas, soil, and groundwater quality and remediation of soil and ground water. Site specific soil gas screening values were derived using the Johnson-Ettinger model.County of Riverside Environmental Health Department (EHD): As Project Manager for a litigation case involving a former agricultural property to be redeveloped for residential use, Ms. Quinn negotiated with the County of Riverside Environmental Health Department (EHD) to develop a soil management plan to handle organochlorine pesticide-impacted soil during site grading. Ms. Quinn supported legal counsel in negotiations with the County District Attorney to resolve a dispute about the representative average concentrations of organochlorine pesticides in the stockpiled soil and its proper disposition. Ms. Quinn characterized the stockpiled soil in accordance with the EPA SW-846 guidance, which includes collection of soil samples at random locations and depths and statistical analysis of the analytical results. Under close scrutiny by the County, Ms. Quinn developed soil management plans to address other on-site soil stockpiles previously generated at the Site, and remaining in-situ DDT-impacted soil requiring characterization and management during final site grading activities. Both methods were approved by the County EHD, and off-site disposal of impacted soil was minimized to hotspot areas where organochlorine pesticide concentrations exceeded USEPA Regional IX and California Preliminary Remediation Goals. Remaining soil was either buried on-site under future roadways or utility trenches, if impacted, or routinely graded and/or exported for use as clean fill.
Technical Analyses
Ms. Quinn has used a variety of analytical and numerical models to simulate fate and transport of contaminants in vadose zone soil, and in groundwater, as follows:• Vadose Zone Fate and Transport Modeling - For several sites, including a former Unocal chemical storage terminal and the Air Force Plant 42, Ms. Quinn used fate and transport modeling to develop soil screening and clean-up values that are higher than conservative levels provided in RWQCB-LA Region guidance, without posing a risk to groundwater. The regulatory agencies agreed to the approach, which involved analysis using the VLEACH model at tremendous cost savings for the clients. • Puente Valley Operable Unit (PVOU) Steering Committee Model Benchmarking - As Senior Hydrogeologist, on behalf of USEPA Region IX, Ms. Quinn reviewed input data and calibration results of a model prepared by the PVOU Steering Committee’s consultant and prepared an independent model using CFEST to benchmark the results. The benchmarked model enabled USEPA and the PVOU Steering Committee to work closely together in refining alternative remediation strategies, and provided USEPA with increased confidence in the Steering Committee’s efforts.• Basin-wide San Gabriel numerical CFEST model refinements - As Lead Hydrogeologist, Ms. Quinn refined the basin-wide San Gabriel numerical CFEST model to assess groundwater flow and solute transport conditions in the South El Monte Operable Unit and Whittier Narrows. Ms. Quinn designed an extraction well network to intercept groundwater contamination migrating toward the Central Basin. Wells were installed using model-derived location, production capacity, and construction specifications.• North Hollywood Operable Unit (NHOU) Extraction Wellfield Evaluation - Ms. Quinn critiqued the production performance of a 2,000-gpm extraction well remediation system, the NHOU extraction wellfield, and evaluated the effectiveness of the system in containing TCE and PCE groundwater contamination. The evaluation included: development of a hydrologic budget; design of aquifer testing; and capture zone and drawdown modeling. The effects of lower water levels on remediation extraction well capacity, and related influence on the capture zone created by the remediation system, were evaluated.• El Toro Marine Corps Air Station, Irvine Sub-basin Model – Using MODFLOW, Ms. Quinn developed a 3D flow model to evaluate remedial alternatives for groundwater contamination, including interpretation of lithologic, geophysical, piezometric pressure, and groundwater chemistry data from hundreds of production and single point and multiport monitoring wells throughout the Irvine Sub-basin, and development of a regional conceptual model that became the basis of a calibrated numerical model. Particle tracking was performed to evaluate vertical flow rates and to develop alternative shallow extraction scenarios effectively balanced with deep groundwater production from the Sub-basin to contain regional TCE groundwater contamination in the area.• Raymond Basin Conjunctive Use Water Supply Management Program - As task manager of Hydrogeology, Ms. Quinn developed conceptual basin operational schemes and a basin-wide ground water flow model using CFEST to simulate and compare artificial recharge and recovery scenarios for drought protection. Geologic properties, historical hydrogeologic patterns, and well capacity information are some of the features Ms. Quinn assimilated into a 3D finite element groundwater flow model for the basin by interfacing GIS data. Ms. Quinn employed the CFEST modeling code to simulate the effect of specific basin operational schemes on groundwater conditions within the basin over projected time intervals.
